More than 200,000 Ohioans who registered to vote this year for the first time or updated their voting information since Jan. 1 could be affected by the latest court ruling requiring the state to set up a new registration verification system by Friday, Secretary of State Jennifer Brunner said. Brunner said she would comply with the U.S. 6th Circuit Court of Appeals ruling late Tuesday but said she is deeply concerned that the decision is a veiled attempt at disenfranchising voters.
The court’s 9-6 opinion, written by Judge Jeffrey Sutton, suggested that voters whose driver’s license number or Social Security number does not exactly match those found on databases maintained by the Ohio Bureau of Motor Vehicles or Social Security Administration could be required to use provisional ballots instead of conventional ones.
“The thing that concerns me is that Judge Sutton indicated that these mismatched names could be subjected to provisional voting and nowhere in [Help America Vote Act] is that the case. The Help America Vote Act is really not meant to be used to disenfranchise or to help determine voter eligibility,” Brunner said in an interview today.
“Essentially that provision of HAVA is basically supposed to maintain voter registration databases,” she said. “It is not for determining voter eligibility. The interpretation that seems to be coming from at least that particular judge takes HAVA and uses it as a means to exclude voters from a regular ballot. That is a concern.”
The full 6th Circuit’s opinion overturned the decision of a three-judge panel at the federal court last week and restored the ruling announced last week by U.S. District Court Judge George C. Smith.
Since Jan. 1, Ohio has 666,000 newly registered or updated voters — all of whom fall under scrutiny by this latest court ruling. Brunner said an initial review found that at least 200,000 of them might have mismatched information. Once the office identifies all of the mismatched voters, Brunner will send the list to the county boards of election where the individuals have registered.
200,000 would seem to be more than that.

Full Sixth Circuit Reverses Panel, Siding With Original Judge That Ohio Secretary of State Must Do Her Job and Stop Election Fraud
She must do her work and turn the verification system back on while awaiting a full hearing which may not come until after the election.

She is compelled to do her job, absent a contrary ruling by the court. It is not as if Brunner is not getting paid to do her job. MORE SNARK.
Darke Blog UPDATE: In looking at the decision, it appears the full court voted 9-6 to hear the case en banc (which means all of them). I’d say the 9-6 vote is a good sign, but doesn’t necessarily mean the case will end that way. Tonight’s decision has been described as the opportunity to “live and fight another day.” But in the world of temporary restraining orders, if you have it, that’s all that matters for the time being. And the time being is what is crucial right now.
Second point – the initial district court decision got some press because the judge found that Brunner was actually violating the law. That dialogue was snuffed out by the subsequent reversal. But now it’s back. When you run into Jennifer Brunner on the street, you can ask her why she’s violating federal election laws.

non-Ohioan Democrat activists have used the Brownlee Avenue address to register themselves to vote in the Buckeye State and secure absentee ballots — all while mobilizing a large effort to register thousands of others for absentee and early voting.
The activists are leaders of a group called “Vote From Home ‘08.” The group is self-identified as having “extensive experience with political organizing, election administration, and Democratic politics.” They were hailed as the “Justice League” by a Daily Kos blogger. Their Facebook page brags: “Want to turn the Presidential election blue in a key swing state? Vote from Home is a political organization that was founded by a team of young people for the purpose of assisting, aiding, and tracking voters to elect progressive candidates to the White House.
I call it aiding and abetting fraud. What do you call it?

The vote of Darnell Nash, one of four people subpoenaed in a Cuyahoga County probe of ACORN’s voter-registration activities, was canceled and his case was turned over to local prosecutors and law enforcement, Board of Elections officials said yesterday.
Nash had registered to vote repeatedly from an address that belonged to a legitimately registered voter, officials said during a hearing at which the subpoenaed voters were to testify.
Board officials had contacted Nash this summer, questioned his address and told him to stop repeat registering.
But still, he breezed into Ohio election offices – the state allows early voting for president – reregistered with a fake address and cast a paper ballot, officials said.
“He came in on 9/30 and Mr. Nash again registered to vote at [someone else's] address, and he cast a ballot,” said board official Jane Platten.

Cleveland’s Bob Frantz of WTAM 1100 wanted to ask Brian Clark, communications director for Ohio Secretary of State Jennifer Brunner, about the court battles she has waged to keep from having to address allegations of voter fraud in early voting.
Why did Brunner block independent observers? Clark attempts to blame Ohio legislature in the conversation.
Got news for this Brunner, it is HER job to protect the voting process. YOU hear that Jennifer, IT IS YOUR JOB. It has become increasingly obvious that she and her team don’t give a damn about protecting the voting process. You are SUPPOSED TO PROTECT THE PROCESS.
If evidence arises that outside groups have tampered or will tamper with an election, the Secretary of State has a duty to act to prevent it, and Brunner has all the authority she needs to protect the process. Listen to the audio when he confronts Clark with actual evidence of ACORN fraud in Cleveland
Ummm, I don’t believe you when you say that the Ohio legislature didn’t prohibit observers for early voting efforts.
We all know who ACORN targets to register at the local Dollar Store or Rescue Mission. Somehow, I don’t think that they are Republicans, mmkay?
He was neither abusive nor blocking Clark from speaking, and yet Clark simply couldn’t handle the conversation.
Ok, Earth to Clark, it is YOUR job to answer why your Boss does what she does.
Clark hung up because Clark has no answer to Frantz’s questions.
