I think he is right. I don’t think that the Constitution allows the federal government to require anyone to purchase anything nor to penalize them for not purchasing anything. The states however have that option as it is not a power enumerated unto the federal government. Since citizens are not able to purchase plans across state lines the commerce clause may not be invoked. The only constitutional manner the federal government could impose what they are proposing would be to federalize the health care industry completely.
It wouldn’t surprise me if states start tacking on extra fees to property tax bills. We pay for schools and other infrastructure that way so why not hospitals.
The hospitals will NEVER lose. There discounts will be in the form of tax abatements so we can suck up the rest. They do it now and aren’t even discreet about it. Look into Tenet.
