WTF? I don’t get it because the last fifty years, federal law has required them to carry their green cards at all times. Do they not have to do this any longer? Shoot, I have to carry insurance cards, licenses, etc. I say Arizona go for it, let the SCOTUS decide after the fact. I foresee papers being filed now.
The judge also put on hold a part of the law that required immigrants to carry their papers at all times, and made it illegal for undocumented workers to solicit employment in public places.
U.S. District Judge Susan Bolton put those controversial sections on hold until the courts resolve the issues.
Sections of S.B. 1070 that Bolton says are preempted by federal law:
Portion of Section 2 of S.B. 1070
A.R.S. § 11-1051(B): requiring that an officer make a reasonable attempt to determine the immigration status of a person stopped, detained or arrested if there is a reasonable suspicion that the person is unlawfully present in the United States, and requiring verification of the immigration status of any person arrested prior to releasing that person
Section 3 of S.B. 1070
A.R.S. § 13-1509: creating a crime for the failure to apply for or carry alien registration papers
Portion of Section 5 of S.B. 1070
A.R.S. § 13-2928(C): creating a crime for an unauthorized alien to solicit, apply for, or perform work
Section 6 of S.B. 1070
A.R.S. § 13-3883(A)(5): authorizing the warrantless arrest of a person where there is probable cause to believe the person has committed a public offense that makes the person removable from the United States.
U.S. District Judge Susan Bolton presided over two federal hearings last Thursday, including a request from the U.S. Justice Department for a preliminary injunction blocking key sections of the law from taking effect.
via Federal judge rules on Arizona’s immigration law.
Shout out to the feds…enforce the law so that the states don’t have to do your dirty work!
July 28, 2010 at 11:01 am
WTF?!
Illegal is legal now? That’s “change”, huh?
July 28, 2010 at 11:02 am
What has happened to the world Anthony?
July 28, 2010 at 11:28 am
The state of Arizona should sue the Federal Government for not enforcing the Laws of the Land.
July 28, 2010 at 11:28 am
Oh and before someone calls me on it I know you can’t sue the FED.
July 28, 2010 at 1:19 pm
It’s the thought that counts DE.
July 28, 2010 at 2:48 pm
You can sue people in the FED!
July 28, 2010 at 3:16 pm
But they aren’t held accountable.
July 28, 2010 at 1:19 pm
I wish they would.
July 28, 2010 at 11:48 am
The Feds won’t uphold the law.
The judge legislates from the bench.
The President refuses to uphold the oath of office.
What’s the point of having laws when this type of thing goes down? This country is so freaking backwards now.
July 28, 2010 at 1:19 pm
This is bs. It’s absolutely disgraceful that this POTUS will do anything for a vote. The citizens of this country are going to be taking a back seat to the non citizen criminals.
July 28, 2010 at 2:50 pm
Yeah like his playing Hollywood starlet-wanna-job on the TV show the Shrew!
July 28, 2010 at 3:17 pm
Uh huh buttered, exactly!
July 28, 2010 at 12:23 pm
Does this mean WE- legal citizens of The United States of America- no longer have to show ID to the police upon request?
WTF is wrong with the world? I just so don’t get it.
One can only pray that SCOTUS gets it before the fraud tips the balance.
July 28, 2010 at 1:20 pm
No, you and I must show proof of everything. Illegal is now the legal.
July 28, 2010 at 2:51 pm
If you’re pulled over just say
“Hablan Espano Senor Policia?”
July 28, 2010 at 3:17 pm
lol buttered
July 28, 2010 at 12:51 pm
Well…the girls on “The View” will get the first shot at the Pres on this issue….I bet the questions will be tuff…But I can see the Pres’s position…He is afraid someone will ask him for his papers.
PS…Have you ever noticed…The pres always says that ” He was raise in Hawaii”.? Or…”When I was growing up in hawaii….” He never has said he was born there.
Someone…needs to escort his ass out of the White House…He is a Fraud.
July 28, 2010 at 1:21 pm
I am convinced that this administration’s work is to hurl this country into civil war. Them vs us. It’s not the illegal aliens that worry me, it’s his administration.
July 28, 2010 at 2:52 pm
Wasn’t he equally raised in a Muslim household in Indonesia?????????
July 28, 2010 at 2:54 pm
Jim, did you catch last week’s issue of that serious journalism paper, the Globe?
http://www.globemagazine.com/story/529
Obama African Birth Certificate!
“Barack Obama’s presidency is illegal! That’s what political insiders are saying after a shocking birth certificate from a hospital in Kenya reveals America’s Commander-in-Chief was born in Africa!”
July 28, 2010 at 2:03 pm
I hope we don’t come to this- but if so- my kids know what the right thing is- preserve, protect and defend the Constitution!
July 28, 2010 at 3:14 pm
I hope it doesn’t come to this PMM, but the Constitution is not the toilet paper that this administration likens it to.
July 28, 2010 at 2:06 pm
I also just found this- France bans the veil and now they are expelling illegals- what is up with this? In Your Face Obama? Clearly according to O roolz- this MUST be racist!
http://news.yahoo.com/s/ap/20100728/ap_on_re_eu/eu_france_angry_roma
SAINT OUEN, France – French President Nicolas Sarkozy on Wednesday ordered authorities to expel Gypsy illegal immigrants and dismantle their camps, amid accusations that his government is acting racist in its treatment of the group known as Roma.
July 28, 2010 at 2:29 pm
No kidding, who would have ever thought France would do the right thing before we did. Oh, and don’t get caught in Mexico without your papers, you will never be seen again. (okay that’s hyperbole, but they do crack down on that sort of thing)
July 28, 2010 at 3:15 pm
I must find the link, but Al Qaeda #2 is really pissed and wants the women to think of themselves as holy warriors.
July 28, 2010 at 2:44 pm
This is such an outrage. I hope the Arizonans start mass lawsuits against the federal government and especially now the DOJ. Class action lawsuits, single personal injury lawsuits, they should start of avalanche of lawsuits. I despise our government now, I truly do. What a bunch of jerks.
July 28, 2010 at 2:56 pm
They’re a bunch of criminals!!!!!!!
July 28, 2010 at 3:16 pm
You aren’t alone and this is our only solace.
July 28, 2010 at 4:11 pm
I’m not exactly sure what this means. The news is trying to portray it as if the judge just shot down the whole law. She did not, she issued a temporary stop on allowing the entire Arizona law to go into effect today. Parts of it can, parts of it can’t. That means she is still considering the case, doesn’t it? She hasn’t made a ruling. she’s simply said that parts of the Arizona law are still being studied and that they can’t enforce them until the legal issues have been ruled on.
July 28, 2010 at 4:23 pm
Yes, but as usual yttik, the MSM wants to play this as a victory for The One.
July 28, 2010 at 6:38 pm
That’s what I think! They’re leaping to conclusions and declaring this an Obama victory. The judge hasn’t finished ruling and by law the only legal thing she can do is order a delay on the parts of the law that she hasn’t yet ruled on.
July 28, 2010 at 8:50 pm
It’s called kick the can or hot potato yttik.
