Giving Vick the key to the city was absolutely sick and I detest Caraway; but I do believe he has a right to privacy. There’s nothing in the tape, recorded in his own home, that made this in any way important to the public. I don’t think it should have been released.

He’s a public figure who will be running for office again. I think that the tape should be made available to the public particularly because of what he said about his spouse who is also a public figure.

I can see it’s in the public’s interest to know if their rep is a loon, but one imagines the public should be able to tell whether or not their rep is a loon without the tape.
if the husband doesn’t press charges then there’s no crime: I don’t see how then the 4th amendment could fail to apply:
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

This is for her benefit as well Nom. If that tape was not released, how do you know that she would not be mandated to undergo psychiatric evaluation? If the situation/tape were swept under the rug, how would she defend herself? They ask to be in public, they most certainly will live in public. I don’t see anything wrong in releasing the tape. If he wanted privacy, the police would not have been called. It’s obvious to me that he wants to hurt her.

until the husband presses charges the matter is private. They are not public figures in their own home.
Under no circumstances does anyone have a right to record persons in their own home without a warrant to do so, and the police did not have one. They have been subjected to unlawful surveillance and they have been subjected to a warrantless seizure of their property (their conversation).
