I have no doubt it will go before the US Supreme Court but I also think that if it does, they will refuse to hear the case until after the 2012 election to be sure it doesn’t interfere with the campaign. I know Justice Kennedy would be the swing vote and he is supposed to be conservative, but I don’t feel confident that he would find the mandate unconstitutional. But then again…who knows? We all know which way Kagen will go, and I’ll never forgive the Republicans who voted her into this position.
